SPECIAL ECONOMIC ZONES

 

FACILITIES & PROVISIONS REGARDING ESTABLISHMENT OF SPECIAL ECONOMIC ZONES IN U.P.

  Special Economic Zones are termed as ‘engines of growth’. Government of India passed SEZ Act 2005 and issued SEZ Rules 2006 to spur the industrial development and to boost exports. Progress of India cannot be possible without the active participation of Uttar Pradesh in growth process, and therefore, in order to encourage SEZ establishment in the State, government issued Uttar Pradesh SEZ Policy 2006 and Uttar Pradesh SEZ (Amended) Policy 2007 ( No. 2129 dated 18.08.2007)
  Salient features and facilities available to SEZs in Uttar Pradesh are given below:

1.

FISCAL INCENTIVES :

  State level Stamp Duty, Registration Fee, Tax, VAT, Levies, Cess reliefs: SEZ Developers, Co-developers and units set up in SEZs are exempt from all kinds of state taxes, levies, cess or taxes imposed by local bodies and authorities. Besides, goods sold from Domestic Tariff Area (DTA) to units in an SEZ, SEZ developer, co-developer shall be exempted from-
 

1.1 State Development Tax ( No. 2542 dated 17.01.2007)

 

1.2 Value Added Tax on sale in SEZ and purchase from DTA ( No. 2027 dated 30.06.2008)

 

1.3 Cess and Mandi Tax( No. 2162 dated 10.11.2008)

 

1.4 Entry Tax on the purchase of diesel & furnace oil (No. 2064 dated 30.06.2008)

 

1.5 Exemption from Stamp Duty on first transaction ( No. 3393 dated 20.09.2007); in NOIDA ( No. 2115 dated 30.05.2006); in Moradabad ( No. 2116 dated 30.05.2006); Stamp Duty exemption on Sub-lease in NEPZ (now NOIDA SEZ) ( No. 3249 dated 22.06.2004)

POWER:

Exemption from Electricity Duty and Taxes on energy generated or purchased for utilisation in service area of SEZ ( No. 2092 dated 07.12.2007) & ( No. 2092 dated 31.03.2008)

SIMPLIFICATION OF LABOUR RULES:

 

3.1 Delegation of Powers of Labour Commissioner to Development Commissioner to ensure timely and regular resolution of labour issues (No. 437 dated 26.02.2007)

 

3.2 To provide single window facility for the resolution of labour issues, services of officers from labour department can be utilized by Development Commissioner. (No. 441 dated 26.02.2007)

 

3.3 Simplification of Single Reporting Format for returns under various Acts (No. 438 dated 26.02.2007) and relief from provisions of U.P. Shops & Commercial Establishment Act 1962 (No. 651 dated 09.05.2003)

4.

RATIONALISATION OF INSPECTIONS:

In order to avoid unnecessary inspections, provision has been made to prepare a schedule for physical inspection in consultation with Development Commissioner. (No. 440 dated 26.02.2007)

5.

POLLUTION CONTROL:

 

5.1 Simplification of process of getting No Objection Certifgicate (No. 3789 dated 30.12.2008)

 

5.2 Issuance of time-bound Clearances/NOC by Pollution Control Board (No. F28101 dated 24.02.2004)

 

5.3 List of projects or Activities requiring prior enviornment clearance under E.I.A. notification S.O. 1533 dated 14.09.2006 of Government of India provides for getting Environmental Clearances for industries, projects, export processing zones and special economic zones.

6.

EMPOWERED COMMITTEE TO EXAMINE SEZ PROPOSALS:

An empowered committee has been formed under the chairmanship of Chief Secretary of the State to examine, recommend and forward proposals to set up SEZs in Uttar Pradesh to the Government of India under the SEZ Act 2005 and Rules 2006. This committee also meets to resolve impediments in the establishment of SEZs. (No. 2283 dated 07.08.2006)

7.

TRANSPORT:

Exemption from Taxes & additional taxes on the transport vehicles to be used within the area of SEZ ( No. 681 dated 16.07.2007)

8.

IRRIGATION:

To facilitate availability of Water supply to SEZs u/s 3(7)4 of UPSEZ (Revised) Policy 2007 Part-A ( No. 4255 dated 03.10.2008)
